45 شبكة ومنظمات حقوقية من 30 دولة  تدين العقوبات الأمريكية الجديدة

على موظفي المحكمة الجنائية الدولية

تدين المنظمات الحقوقية الموقعة أدناه الدفعة الجديدة من العقوبات التي فرضتها الإدارة الأمريكية على رئيسة المحكمة، القاضية توموكو أكاني، وكبير المحامين في مكتب المدعي العام، المحامي عبد الله سيي.

وتأتي هذه العقوبات بحق المحكمة الجنائية الدولية وموظفيها، على خلفية قيامهم بمهامهم بكل مهنية ووفقًا لأحكام نظام روما الأساسي. وتهدف هذه العقوبات إلى تقويض عمل المحكمة الجنائية الدولية. إضافة إلى هدف حماية مسؤولين إسرائيليين، وفي مقدمتهم رئيس الوزراء الإسرائيلي بنيامين نتنياهو، المشتبه بهم لدى المحكمة من المثول أمام المحكمة على خلفية الجرائم المرتكبة بحق الفلسطينيين في قطاع غزة.

وتمثل هذه العقوبات الأمريكية غير القانونية، سعي إدارة الولايات المتحدة إلى تقويض استقلال القضاء الدولي. وتدعم هذه الإجراءات القسرية سياسة الإفلات من العقاب، وتهدد سيادة القانون ، وتُضعف قدرة الهيئات القضائية الدولية على إنصاف ضحايا الجرائم ضد الإنسانية وجرائم الحرب من الوصول إلى العدالة.

أخيرا تعرب المنظمات الموقعة عن  تضامنها مع محكمة  الجنايات الدولية وموظفيها، ودعمها لمواصلة استقلال المحكمة ونزاهتها. كما تطالب الدول الأطراف في نظام روما الأساسي لاتخاذ إجراءات ملموسة وفعالة لحماية المحكمة والحفاظ على استقلالها، بعيدًا عن  الترهيب بالعقوبات أو التهديد بها.

45 human rights networks and organizations from 30 countries condemn new US sanctions on ICC staff

The undersigned human rights organizations condemn the new round of sanctions imposed by the US administration on the President of the Court, Judge Tomoko Akane, and the Chief Counsel of the Office of the Prosecutor, Attorney Abdoulaye Seye.

These sanctions against the International Criminal Court (ICC) and its staff come in response to their lawful exercise of their duties in accordance with the Rome Statute. These sanctions aim to undermine the work of the ICC and to shield Israeli officials, including Prime Minister Benjamin Netanyahu, who are suspects in the Court’s investigations into crimes committed against Palestinians in the Gaza Strip.

These illegal US sanctions represent the US administration’s attempt to undermine the independence of international justice. These coercive measures promote impunity, threaten the rule of law, and weaken the ability of international judicial bodies to provide justice for victims of crimes against humanity and war crimes.

Finally, the undersigned organizations express their solidarity with the ICC and its staff and their support for the Court’s continued independence and integrity. It also calls on States Parties to the Rome Statute to take concrete and effective measures to protect the Court and preserve its independence, free from intimidation by sanctions or threats thereof.

45 réseaux et organisations de défense des droits humains issus de 30 pays condamnent les nouvelles sanctions américaines contre le personnel de la CPI

Les organisations de défense des droits de l’homme soussignées condamnent la nouvelle série de sanctions imposées par l’administration américaine à l’encontre de la présidente de la Cour, la juge Tomoko Akane, et du premier substitut du Bureau du Procureur, Maître Abdoulaye Seye.

Ces sanctions à l’encontre de la Cour Pénale Internationale (CPI) et de son personnel font suite à l’exercice légitime de leurs fonctions conformément au Statut de Rome. Elles visent à entraver le travail de la CPI et à protéger les responsables israéliens, dont le Premier ministre Benjamin Netanyahu, qui font l’objet d’enquêtes menées par la Cour concernant des crimes commis à l’encontre des Palestiniens dans la bande de Gaza.

Ces sanctions illégales des États-Unis constituent une tentative de l’administration américaine de porter atteinte à l’indépendance de la justice internationale. Ces mesures coercitives favorisent l’impunité, menacent l’État de droit et affaiblissent la capacité des instances judiciaires internationales à rendre justice aux victimes de crimes contre l’humanité et de crimes de guerre.

Enfin, les organisations soussignées expriment leur solidarité avec la CPI et son personnel, ainsi que leur soutien au maintien de l’indépendance et de l’intégrité de la Cour. Elles appellent également les États parties au Statut de Rome à prendre des mesures concrètes et efficaces pour protéger la Cour et préserver son indépendance, à l’abri de toute intimidation par des sanctions ou des menaces de sanctions.
