The Amman Center for Human Rights Studies (ACHRS), the Arab Coalition against the Death Penalty (ACADP) and the Jordan Coalition against the Death Penalty (JCADP) <\/strong>welcomes the Lebanese Parliament\u2019s decision to abolish the death penalty, recognizing it as a significant step towards the full realization of the right to life. As a long-standing advocate for abolition, ACHRS considers this a particularly significant development in a region where capital punishment is, not only deeply entrenched, but increasingly common. Once enacted, the bill will make Lebanon the first country in the Middle East to abolish the death penalty. ACHRS urges other states in the region to follow Lebanon\u2019s lead and begin taking concrete steps towards full abolition. At a time of profound regional uncertainty, crisis must not become a reason for inaction, but an impetus for greater commitment to protecting human rights.<\/p>\n

Lebanon Votes to Abolish the Death Penalty<\/strong><\/p>\n

On 11 August 2026, the Lebanese Parliament voted<\/a> to abolish the death penalty. By modifying Article 37 of Lebanon\u2019s Penal Code No. 340 of 1943<\/a>, the new bill removes the death penalty as a possible punishment for any crime, replacing it with life imprisonment with hard labour<\/a>. The measure received widespread, largely bipartisan support<\/a> in Lebanon\u2019s 128-seat Parliament, with Hezbollah\u2019s parliamentary bloc representing the main opposition<\/a>. While its implementation remains subject to presidential approval, this is largely regarded as a formality. With President Joseph Aoun\u2019s government having already expressed support<\/a> for the measure, the bill is expected to be signed into law without objection.<\/p>\n

Until now, Lebanon was classified as a de facto<\/em> abolitionist state\u2013 that is, a country that retains the death penalty in law but has not carried out an execution for 10 years or more. Although Lebanon has maintained a 22-year long moratorium on executions\u2013 with the last of these having taken place in January 2004<\/a>\u2013 its courts have continued to impose death sentences. As of early 2026, an estimated 85 people<\/a>remained on death row. Following the bill\u2019s approval, these sentences will be commuted<\/a> to life imprisonment with hard labour.<\/p>\n

A Historic First for the Region<\/strong><\/p>\n

Once signed into law, the bill will make Lebanon the first country<\/a> in the Middle East to abolish the death penalty, offering a powerful example of progress in a region where capital punishment is on the rise. Indeed, Amnesty International\u2019s yearly report<\/a> on the death penalty revealed that 2025 was the year with the highest number of recorded executions since 1981. The vast majority of these were attributed to the Middle East.<\/p>\n

This increase comes amid heightened regional tensions, with several states expanding the use of the death penalty under the guise of national security. Already responsible for the majority<\/a> of executions recorded that year, Iran expanded the application of capital punishment in late 2025 to individuals convicted of collaborating with \u201chostile states\u201d<\/a>. Following renewed US-Israeli aggression against Iran in February 2026, at least 56 people<\/a> were executed under these expanded national security provisions. Closer to Lebanon, Jordan resumed executions<\/a> in June 2026 after a nine-year moratorium, executing six people convicted of terrorism- and drug-related offences. Meanwhile, in occupied Palestine, Israeli authorities enacted legislation<\/a> mandating the death penalty for Palestinians convicted of terrorism-related offences.<\/p>\n

At a time when much of the region is moving backwards, Lebanon offers a powerful reminder that the right to life is non-negotiable, even in times of crisis. The country is itself enduring profound turmoil, with the Israeli invasion displacing more than 350,000 people<\/a> and killing at least 4,346<\/a>. Rather than allowing this crisis to diminish its commitment to human rights, Lebanon has shown that protecting life becomes all the more important when it is most threatened.<\/p>\n

A Model for Regional Progress<\/strong><\/p>\n

Lebanon\u2019s move towards abolition did not happen overnight; it is the culmination of nearly five decades of campaigning and advocacy. Efforts began in the 1980s<\/a>, led by Dr Walid Slaibi and Dr Ogarit Younan, who went on to establish the National Campaign Against the Death Penalty in Lebanon in 1997<\/a>. Through advocacy, policy and education, they worked to shift public attitudes towards capital punishment.<\/p>\n

While progress was gradual, their efforts began to yield results. Lebanon took a series of incremental steps towards abolition, including the repeal<\/a> of the mandatory death sentence for murder by Parliament in 2001. Following widespread public and international outrage<\/a> over the execution of three men convicted of violent crimes in January 2004, several Ministers of Justice declared that they would refuse to sign execution warrants<\/a>, resulting in a de facto 22-year moratorium on executions. In 2011, legislation was adopted<\/a> to formalise the status of death-row prisoners and allow for sentence reductions. Lebanon also strengthened its commitment to abolition at the international level, voting in favour<\/a> of UN resolutions calling for a moratorium on the use of the death penalty in 2020, 2022 and 2026, after having previously abstained<\/a> from such resolutions since the first vote in 2007.<\/p>\n

Likewise, this latest bill is not Lebanon\u2019s first attempt at full legal abolition. Previous efforts include a draft law<\/a> proposed by Walid Slaibi in 2004, a bill<\/a> submitted to the Council of Ministers by then-Minister of Justice Ibrahim Najjar in 2008, and another introduced<\/a> by MP Elie Keyrouz in 2012. Although these initiatives did not succeed, they helped build the political and legal momentum that ultimately paved the way for today\u2019s progress.<\/p>\n

The Path Towards Abolition<\/strong><\/p>\n

Lebanon demonstrates that change need not happen overnight; it can be gradual and incremental. But it must begin somewhere.<\/p>\n

ACHRS, ACADP and JCADP calls<\/strong> on Arab States to follow Lebanon\u2019s lead and take meaningful steps towards abolishing the death penalty. Recognising that the first and most important step is an immediate halt to executions, and in line with the 2008 Alexandria Declaration<\/a>, ACHRS, ACADP and JCADP calls on the Arab League and other regional bodies to establish a moratorium on executions. Given that the application of the death penalty in many Arab countries exceeds<\/a> the limits permitted under Sharia law, ACHRS, ACADP and JCADP further calls on the Organisation of Islamic Cooperation (OIC) to support and advance such a moratorium.<\/p>\n

While welcoming states that have already instituted de facto moratoria, ACHRS, ACADP and JCADP urges them to move towards full legal abolition. This includes Morocco, which last carried out an execution in 1993<\/a>, and Tunisia, whose last execution took place in 1991<\/a>. Despite these longstanding moratoria, both countries continue to impose death sentences, leaving prisoners in prolonged uncertainty. Given the severe psychological toll<\/a> of living under a death sentence, as well as the financial and institutional costs of maintaining death-row systems, it is imperative that these states take the next step towards full legal abolition.<\/p>\n

The region is navigating a period of profound uncertainty. Yet uncertainty and crisis must not become excuses to delay progress on human rights; they must instead be met with renewed commitment to action. At a time of great loss, ACHRS, ACADP and JCADP urges states to reaffirm their commitment to the right to life and take meaningful steps to ensure it is protected.<\/p>\n

D\u00e9claration conjointe<\/strong><\/p>\n

L\u2019ACHRS, l\u2019ACADP et la JCADP saluent la d\u00e9cision du Parlement libanais d\u2019abolir la peine de mort et appellent les \u00c9tats arabes \u00e0 suivre l\u2019exemple du Liban<\/strong>\u00a0<\/strong><\/p>\n

Le Centre d\u2019Amman pour les \u00c9tudes sur les Droits de l\u2019Homme (ACHRS), la Coalition Arabe contre la Peine de Mort (ACADP) et la Coalition Jordanienne contre la Peine de Mort (JCADP)<\/strong> se f\u00e9licitent de la d\u00e9cision du Parlement libanais d\u2019abolir la peine de mort, consid\u00e9r\u00e9e comme une avanc\u00e9e majeure vers la pleine r\u00e9alisation du droit \u00e0 la vie. En tant que d\u00e9fenseur historique de l\u2019abolition, l\u2019ACHRS consid\u00e8re qu\u2019il s\u2019agit l\u00e0 d\u2019une avanc\u00e9e particuli\u00e8rement importante dans une r\u00e9gion o\u00f9 la peine capitale est non seulement profond\u00e9ment ancr\u00e9e, mais aussi de plus en plus courante. Une fois promulgu\u00e9, ce projet de loi fera du Liban le premier pays du Moyen-Orient \u00e0 abolir la peine de mort. L\u2019ACHRS exhorte les autres \u00c9tats de la r\u00e9gion \u00e0 suivre l\u2019exemple du Liban et \u00e0 commencer \u00e0 prendre des mesures concr\u00e8tes en vue de l\u2019abolition totale. En cette p\u00e9riode de profonde incertitude r\u00e9gionale, la crise ne doit pas devenir un pr\u00e9texte \u00e0 l\u2019inaction, mais un \u00e9lan vers un engagement accru en faveur de la protection des droits de l\u2019homme.<\/p>\n

Le Liban Vote l\u2019Abolition de la Peine de Mort<\/strong><\/p>\n

Le 11 ao\u00fbt 2026, le Parlement libanais a vot\u00e9<\/a> l’abolition de la peine de mort. En modifiant l\u2019article 37 du Code P\u00e9nal libanais n\u00b0 340 de 1943<\/a>, le nouveau projet de loi supprime la peine de mort en tant que sanction possible pour tout crime, la rempla\u00e7ant par la r\u00e9clusion \u00e0 perp\u00e9tuit\u00e9 avec travaux forc\u00e9s<\/a>. Cette mesure a b\u00e9n\u00e9fici\u00e9 d\u2019un large soutien largement bipartisan<\/a> au sein du Parlement libanais, qui compte 128 si\u00e8ges. Le bloc parlementaire du Hezbollah repr\u00e9sentait la principale opposition<\/a>. Bien que sa mise en \u0153uvre reste soumise \u00e0 l\u2019approbation pr\u00e9sidentielle, celle-ci est largement consid\u00e9r\u00e9e comme une formalit\u00e9. Le gouvernement du pr\u00e9sident Joseph Aoun ayant d\u00e9j\u00e0 exprim\u00e9 son soutien<\/a> \u00e0 cette mesure, le projet de loi devrait \u00eatre promulgu\u00e9 sans objection.<\/p>\n

Jusqu\u2019\u00e0 pr\u00e9sent, le Liban \u00e9tait class\u00e9 parmi les \u00c9tats abolitionnistes de facto\u2013 c\u2019est-\u00e0-dire un pays qui maintient la peine de mort dans sa l\u00e9gislation mais n\u2019a pas proc\u00e9d\u00e9 \u00e0 d\u2019ex\u00e9cution depuis dix ans ou plus. Bien que le Liban ait maintenu un moratoire sur les ex\u00e9cutions depuis 22 ans\u2013 la derni\u00e8re ayant eu lieu en janvier 2004<\/a>\u2013 ses tribunaux ont continu\u00e9 \u00e0 prononcer des condamnations \u00e0 mort. D\u00e9but 2026, on estimait \u00e0 85 personnes<\/a> le nombre de condamn\u00e9s \u00e0 mort. Suite \u00e0 l\u2019adoption du projet de loi, ces peines seront commu\u00e9es<\/a> en r\u00e9clusion \u00e0 perp\u00e9tuit\u00e9 avec travaux forc\u00e9s.<\/p>\n

Une Avanc\u00e9e Historique dans la R\u00e9gion<\/strong><\/p>\n

Une fois promulgu\u00e9e, cette loi fera du Liban le premier pays<\/a> du Moyen-Orient \u00e0 abolir la peine de mort, offrant ainsi un exemple fort de progr\u00e8s dans une r\u00e9gion o\u00f9 le recours \u00e0 la peine capitale est en hausse. En effet, le rapport annuel<\/a>d\u2019Amnesty International sur la peine de mort a r\u00e9v\u00e9l\u00e9 que 2025 \u00e9tait l\u2019ann\u00e9e ayant enregistr\u00e9 le plus grand nombre d\u2019ex\u00e9cutions depuis 1981. La grande majorit\u00e9 de celles-ci ont eu lieu au Moyen-Orient.<\/p>\n

Cette augmentation intervient dans un contexte de tensions r\u00e9gionales accrues, plusieurs \u00c9tats \u00e9tendant le recours \u00e0 la peine de mort sous pr\u00e9texte de s\u00e9curit\u00e9 nationale. D\u00e9j\u00e0 responsable de la majorit\u00e9<\/a> des ex\u00e9cutions recens\u00e9es cette ann\u00e9e-l\u00e0, l\u2019Iran a \u00e9largi l\u2019application de la peine capitale fin 2025 aux personnes reconnues coupables de collaboration avec des \u00ab \u00c9tats hostiles \u00bb<\/a>. \u00c0 la suite d\u2019une nouvelle agression am\u00e9ricano-isra\u00e9lienne contre l\u2019Iran en f\u00e9vrier 2026, au moins 56 personnes<\/a> ont \u00e9t\u00e9 ex\u00e9cut\u00e9es en vertu de ces dispositions \u00e9largies relatives \u00e0 la s\u00e9curit\u00e9 nationale. Plus pr\u00e8s du Liban, la Jordanie a repris les ex\u00e9cutions<\/a> en juin 2026 apr\u00e8s un moratoire de neuf ans, ex\u00e9cutant six personnes reconnues coupables d\u2019infractions li\u00e9es au terrorisme et au trafic de drogue. Parall\u00e8lement, en Palestine occup\u00e9e, les autorit\u00e9s isra\u00e9liennes ont adopt\u00e9 une l\u00e9gislation<\/a> imposant la peine de mort aux Palestiniens reconnus coupables d\u2019infractions li\u00e9es au terrorisme.<\/p>\n

\u00c0 l\u2019heure o\u00f9 une grande partie de la r\u00e9gion recule, le Liban rappelle avec force que le droit \u00e0 la vie n\u2019est pas n\u00e9gociable, m\u00eame en temps de crise. Le pays traverse lui-m\u00eame de profonds bouleversements, l\u2019invasion isra\u00e9lienne ayant provoqu\u00e9 le d\u00e9placement de plus de 350 000 personnes<\/a> et fait au moins 4 346<\/a> morts. Plut\u00f4t que de laisser cette crise affaiblir son engagement en faveur des droits de l\u2019homme, le Liban a montr\u00e9 que la protection de la vie devient d\u2019autant plus importante lorsqu\u2019elle est le plus menac\u00e9e.<\/p>\n

Un Mod\u00e8le de Progr\u00e8s R\u00e9gional<\/strong><\/p>\n

\u00a0<\/strong>Le cheminement du Liban vers l\u2019abolition ne s\u2019est pas fait du jour au lendemain; il est l\u2019aboutissement de pr\u00e8s de cinq d\u00e9cennies de campagne et de plaidoyer. Les efforts ont d\u00e9but\u00e9 dans les ann\u00e9es 1980<\/a>, sous l\u2019impulsion du Dr Walid Slaibi et du Dr Ogarit Younan, qui ont ensuite fond\u00e9 la Campagne nationale contre la peine de mort au Liban en 1997<\/a>. Par le biais de la sensibilisation, des politiques publiques et de l\u2019\u00e9ducation, ils ont \u0153uvr\u00e9 pour faire \u00e9voluer les mentalit\u00e9s \u00e0 l\u2019\u00e9gard de la peine capitale.<\/p>\n

Bien que les progr\u00e8s aient \u00e9t\u00e9 graduels, leurs efforts ont commenc\u00e9 \u00e0 porter leurs fruits. Le Liban a pris une s\u00e9rie de mesures progressives en faveur de l\u2019abolition, notamment l\u2019abrogation<\/a> par le Parlement, en 2001, de la peine de mort obligatoire en cas de meurtre. \u00c0 la suite de l\u2019indignation<\/a> g\u00e9n\u00e9ralis\u00e9e de l\u2019opinion publique et de la communaut\u00e9 internationale face \u00e0 l\u2019ex\u00e9cution, en janvier 2004, de trois hommes reconnus coupables de crimes violents, plusieurs Ministres de la Justice ont d\u00e9clar\u00e9 qu\u2019ils refuseraient de signer les mandats d\u2019ex\u00e9cution<\/a>, ce qui a abouti \u00e0 un moratoire de facto sur les ex\u00e9cutions depuis 22 ans. En 2011, une loi a \u00e9t\u00e9 adopt\u00e9e<\/a> afin de formaliser le statut des condamn\u00e9s \u00e0 mort et de permettre des r\u00e9ductions de peine. Le Liban a \u00e9galement renforc\u00e9 son engagement en faveur de l\u2019abolition au niveau international, en votant en faveur<\/a> des r\u00e9solutions de l\u2019ONU appelant \u00e0 un moratoire sur le recours \u00e0 la peine de mort en 2020, 2022 et 2026, apr\u00e8s s\u2019\u00eatre auparavant abstenu<\/a> sur ces r\u00e9solutions depuis le premier vote en 2007.<\/p>\n

De m\u00eame, ce dernier projet de loi n\u2019est pas la premi\u00e8re tentative du Liban en vue d\u2019une abolition l\u00e9gale totale. Parmi les efforts ant\u00e9rieurs, on peut citer un projet de loi<\/a> propos\u00e9 par Walid Slaibi en 2004, un projet de loi<\/a> soumis au Conseil des ministres par le ministre de la Justice de l\u2019\u00e9poque, Ibrahim Najjar, en 2008, et un autre pr\u00e9sent\u00e9<\/a> par le d\u00e9put\u00e9 Elie Keyrouz en 2012. Bien que ces initiatives n\u2019aient pas abouti, elles ont contribu\u00e9 \u00e0 cr\u00e9er la dynamique politique et juridique qui a finalement ouvert la voie aux progr\u00e8s actuels.<\/p>\n

La Voie Vers l\u2019Abolition<\/strong><\/p>\n

\u00a0<\/strong>Le Liban montre que le changement ne se fait pas du jour au lendemain; il peut \u00eatre progressif et graduel. Mais il faut bien commencer quelque part.<\/p>\n

L’ACHRS, l’ACADP et la JCADP appellent les \u00c9tats arabes \u00e0 suivre l\u2019exemple du Liban et \u00e0 prendre des mesures concr\u00e8tes en vue de l\u2019abolition de la peine de mort. Reconnaissant que la premi\u00e8re \u00e9tape, et la plus importante, consiste \u00e0 mettre imm\u00e9diatement fin aux ex\u00e9cutions, et conform\u00e9ment \u00e0 la D\u00e9claration d\u2019Alexandrie de 2008<\/a>, l\u2019ACHRS, l\u2019ACADP et la JCADP appellent la Ligue Arabe et les autres instances r\u00e9gionales \u00e0 instaurer un moratoire sur les ex\u00e9cutions. \u00c9tant donn\u00e9 que l\u2019application de la peine de mort dans de nombreux pays arabes d\u00e9passe<\/a> les limites autoris\u00e9es par la Charia, l\u2019ACHRS, l\u2019ACADP et le JCADP appellent en outre l\u2019Organisation de la Coop\u00e9ration Islamique (OCI) \u00e0 soutenir et \u00e0 promouvoir un tel moratoire.<\/p>\n

Tout en saluant les \u00c9tats qui ont d\u00e9j\u00e0 instaur\u00e9 des moratoires de facto, l\u2019ACHRS, l\u2019ACADP et le JCADP les exhortent \u00e0 s\u2019engager sur la voie d\u2019une abolition l\u00e9gale totale. C’est notamment le cas du Maroc, o\u00f9 la derni\u00e8re ex\u00e9cution a eu lieu en 1993<\/a>, et de la Tunisie, o\u00f9 la derni\u00e8re ex\u00e9cution remonte \u00e0 1991<\/a>. Malgr\u00e9 ces moratoires de longue date, ces deux pays continuent de prononcer des condamnations \u00e0 mort, laissant les d\u00e9tenus dans une incertitude prolong\u00e9e. Compte tenu du lourd fardeau psychologique<\/a> que repr\u00e9sente le fait de vivre sous le coup d’une condamnation \u00e0 mort, ainsi que des co\u00fbts financiers et institutionnels li\u00e9s au maintien des syst\u00e8mes de peine capitale, il est imp\u00e9ratif que ces \u00c9tats franchissent une nouvelle \u00e9tape vers l’abolition l\u00e9gale totale.<\/p>\n

La r\u00e9gion traverse une p\u00e9riode de profonde incertitude. Pourtant, l\u2019incertitude et la crise ne doivent pas servir de pr\u00e9textes pour retarder les progr\u00e8s en mati\u00e8re de droits de l\u2019homme; elles doivent au contraire \u00eatre affront\u00e9es par un engagement renouvel\u00e9 en faveur de l\u2019action. En cette p\u00e9riode de grandes pertes, l\u2019ACHRS, l\u2019ACADP et la JCADP exhortent les \u00c9tats \u00e0 r\u00e9affirmer leur engagement en faveur du droit \u00e0 la vie et \u00e0 prendre des mesures concr\u00e8tes pour garantir sa protection.<\/p>\n
