<\/p>\n<p style=\"text-align: justify\"> <span style=\"font-size: 10pt; font-family: Tahoma\">According to the Landlords and Tenants Law (the Law) of <\/span><span style=\"font-size: 10pt; font-family: Tahoma\">Jordan<\/span><span style=\"font-size: 10pt; font-family: Tahoma\">, all leases negotiated before the year 2000, will expire by the end of the year 2010.<span>&nbsp; <\/span>It is estimated that the majority of existing leases within <\/span><span style=\"font-size: 10pt; font-family: Tahoma\">Amman<\/span><span style=\"font-size: 10pt; font-family: Tahoma\"> will expire under this law, throwing the Jordanian rental market-especially for commercial properties-into chaos.<span>&nbsp; <\/span><\/span> <\/p>\n<p>  <!--more--> <\/p>\n<p style=\"text-align: justify\"> <span style=\"font-size: 10pt; font-family: Tahoma\">As a response to this pending crisis, the <\/span><span style=\"font-size: 10pt; font-family: Tahoma\">Amman<\/span><span style=\"font-size: 10pt; font-family: Tahoma\"> <\/span><span style=\"font-size: 10pt; font-family: Tahoma\">Center<\/span><span style=\"font-size: 10pt; font-family: Tahoma\"> for Human Rights Studies (&quot;ACHRS&quot;), researched the situation in <\/span><span style=\"font-size: 10pt; font-family: Tahoma\">Jordan<\/span><span style=\"font-size: 10pt; font-family: Tahoma\"> within the broader context of international human rights law.<span>&nbsp; <\/span>The multi-faceted investigation included a review of the relevant Jordanian legislation, a study of recent press clippings and public discussion surrounding the Landlords and Tenants Law and meetings with a variety of stakeholders and rental experts in <\/span><span style=\"font-size: 10pt; font-family: Tahoma\">Amman<\/span><span style=\"font-size: 10pt; font-family: Tahoma\">.<span>&nbsp; <\/span>Additionally, legal research on the right to adequate housing and <\/span><span style=\"font-size: 10pt; font-family: Tahoma\">Jordan<\/span><span style=\"font-size: 10pt; font-family: Tahoma\">&#8216;s obligations under international human rights law was conducted; it is annexed to this document.<span>&nbsp; <\/span>Guided by this research, the ACHRS has the following recommendations to offer:<\/span>  <\/p>\n<p style=\"text-align: justify\"> <span style=\"font-size: 10pt; font-family: Tahoma\"><\/span> <\/p>\n<p style=\"margin-left: 0.5in; text-indent: -0.25in; text-align: justify; tab-stops: .5in\"> <span style=\"font-size: 9pt; font-family: StarSymbol\"><span>&bull;&#9679;<span style=\"font-family: 'Times New Roman'\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span dir=\"ltr\"><span style=\"font-size: 10pt; font-family: Tahoma\">Given the risk of large-scale eviction and displacement under the current Law, there is definite need for governmental involvement in this matter and <\/span><\/span><b><span style=\"font-size: 10pt; font-family: Tahoma\">the Landlords and Tenants Law must be amended<\/span><\/b><u><span style=\"font-size: 10pt; font-family: Tahoma\">.<\/span><\/u><u><span style=\"font-size: 10pt; font-family: Tahoma\"><\/span><\/u>  <\/p>\n<p style=\"margin-left: 0.5in; text-indent: -0.25in; text-align: justify; tab-stops: .5in\"> <span style=\"font-size: 9pt; font-family: StarSymbol\"><span>&bull;&#9679;<span style=\"font-family: 'Times New Roman'\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span dir=\"ltr\"><b><span style=\"font-size: 10pt; font-family: Tahoma\">The amendment to the Law should be made as soon as possible, so that tenants, landlords, investors and the Jordanian community can plan accordingly.<\/span><\/b><\/span><b><span style=\"font-size: 10pt; font-family: Tahoma\"><\/span><\/b>  <\/p>\n<p style=\"margin-left: 0.5in; text-indent: -0.25in; text-align: justify; tab-stops: .5in\"> <span style=\"font-size: 9pt; font-family: StarSymbol\"><span>&bull;&#9679;<span style=\"font-family: 'Times New Roman'\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span dir=\"ltr\"><span style=\"font-size: 10pt; font-family: Tahoma\">This amendment should <\/span><\/span><b><span style=\"font-size: 10pt; font-family: Tahoma\">balance both the rights and the needs of tenants and landlords<\/span><\/b><span style=\"font-size: 10pt; font-family: Tahoma\">, rather than favoring one over the other.<\/span><span style=\"font-size: 10pt; font-family: Tahoma\"><\/span>  <\/p>\n<p style=\"margin-left: 0.5in; text-indent: -0.25in; text-align: justify; tab-stops: .5in\"> <span style=\"font-size: 9pt; font-family: StarSymbol\"><span>&bull;&#9679;<span style=\"font-family: 'Times New Roman'\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span dir=\"ltr\"><span style=\"font-size: 10pt; font-family: Tahoma\">Because of the different particularities of commercial and residential leases, <\/span><\/span><b><span style=\"font-size: 10pt; font-family: Tahoma\">the Law should address residential and commercial leases separately<\/span><\/b><span style=\"font-size: 10pt; font-family: Tahoma\">.<\/span><span style=\"font-size: 10pt; font-family: Tahoma\"><\/span>  <\/p>\n<p style=\"margin-left: 0.5in; text-indent: -0.25in; text-align: justify; tab-stops: .5in\"> <span style=\"font-size: 9pt; font-family: StarSymbol\"><span>&bull;&#9679;<span style=\"font-family: 'Times New Roman'\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span dir=\"ltr\"><span style=\"font-size: 10pt; font-family: Tahoma\">The potential social crisis that could result in 2010 must be avoided-<\/span><\/span><b><span style=\"font-size: 10pt; font-family: Tahoma\">the amended Law must be designed to avoid wide-scale displacement or homelessness, and should provide for alternate housing as needed.<\/span><\/b><u><span style=\"font-size: 10pt; font-family: Tahoma\"><\/span><\/u>  <\/p>\n<p style=\"margin-left: 0.5in; text-indent: -0.25in; text-align: justify; tab-stops: .5in\"> <span style=\"font-size: 9pt; font-family: StarSymbol\"><span>&bull;&#9679;<span style=\"font-family: 'Times New Roman'\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span dir=\"ltr\"><span style=\"font-size: 10pt; font-family: Tahoma\">Finally, given the complexities of the issue, <\/span><\/span><b><span style=\"font-size: 10pt; font-family: Tahoma\">a committee should be formed to evaluate the current situation and to monitor rental law as necessary in the future<\/span><\/b><span style=\"font-size: 10pt; font-family: Tahoma\">, to avoid a similar crisis from evolving again.<span>&nbsp; <\/span>Such a committee should ensure sufficient participation and representation of possibly affected parties.<\/span>  <\/p>\n<p style=\"margin-left: 0.5in; text-indent: -0.25in; text-align: justify; tab-stops: .5in\"> <span style=\"font-size: 9pt; font-family: StarSymbol\"><span>&bull;&#9679;<span style=\"font-family: 'Times New Roman'\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span dir=\"ltr\"><b><span style=\"font-size: 10pt; font-family: Tahoma\">When addressing the Law, <\/span><\/b><\/span><b><span style=\"font-size: 10pt; font-family: Tahoma\">Jordan<\/span><\/b><b><span style=\"font-size: 10pt; font-family: Tahoma\"> must be guided by the principles embodied in the right to adequate housing.<span>&nbsp; <\/span>Accordingly, <\/span><\/b><b><span style=\"font-size: 10pt; font-family: Tahoma\">Jordan<\/span><\/b><b><span style=\"font-size: 10pt; font-family: Tahoma\"> must recognize, respect, protect and fulfill the right to adequate housing, and meet its legal obligations, as outlined in the annexed memorandum<\/span><\/b><span style=\"font-size: 10pt; font-family: Tahoma\">.<\/span>  <\/p>\n<p style=\"text-align: justify\"> <span style=\"font-size: 10pt; font-family:
